§ 13-276. Administration.

  • (a)

    The police department and code services division of the city shall be responsible for the administration and enforcement of this article. The police department shall be responsible for administering the removal and disposition of vehicles determined to be abandoned on the public streets and highways within the city and on property owned by the city. The code services division shall be responsible for administering the removal and disposition of abandoned, nuisance and junked motor vehicles located on private property.

    (b)

    If appropriate inspecting officers have probable cause to expect a violation of this article, they shall have the right, upon presentation of proper credentials, to enter on any premises within the city ordinance-making jurisdiction at any reasonable hour in order to determine if any motor vehicle is in violation of this article.

    (c)

    The city may, on an annual basis, contract with private tow truck operators or towing businesses to remove, store, and dispose of abandoned vehicles, nuisance vehicles, and junked motor vehicles in compliance with this article and applicable state laws.

    (d)

    Nothing in this article shall be construed to limit the legal authority or powers of officers of the city police department or fire department in enforcing other laws or in otherwise carrying out their duties.
