§ 25-301. Definitions.

  • The following terms as used in this article are defined as follows:

    Applicant means that person who is financially responsible for the proposed water distribution or sewer collection system construction or modification. The applicant becomes the "permittee" under this article when a permit is issued, assuming new responsibilities and retaining all the same responsibilities as the applicant has under this article.

    Application means the form or forms provided by the City of Salisbury and completed by the design engineer and applicant providing pertinent information regarding the proposed construction or modification of water distribution or sewer collection facilities. It includes all required associated documents.

    City means the City of Salisbury, North Carolina.

    City engineer means the Salisbury City Engineer or his duly authorized agent or representative who shall be responsible for the administration of the delegated local permitting authority program under this article and shall be the designated party to receive service of documents pertaining to such program.

    Construction permit means the written document which is issued by the city engineer's office in accordance with this article, describing the specific construction and/or modification activity allowed, and including any and all general, supplemental and special conditions to the permit.

    Design engineer means the professional engineer, licensed to practice in the State of North Carolina, responsible for performing the design and preparing the drawings and specifications for the proposed water distribution system and/or sewer collection system construction or modification, and responsible for certifying completion of such construction or modification substantially in accordance with the approved plans and permit.

    Development services means the development services division, a division of the City of Salisbury. Development services shall serve as the drop-off and pick-up location for applications, documents and permits subject to this article.

    Documents means any and all drawings, graphs, charts, calculations, compilations of data, writings, photographs, audio or video tape recordings or other such records from which project pertinent information can be obtained, extracted or translated in a usable form.

    Nonconformance notice means written notice to the applicant, design engineer and/or contractor when construction or operation performed under local permit is found to not substantially conform to the approved permit design, the requirements of the City of Salisbury, or the requirements of NCDENR.

    Operation permit means the written document which is issued by the city engineer's office in accordance with this article, documenting final approval of construction and providing for operational responsibility for the facilities upon completion of the permitted work, including any and all general, supplemental and special conditions to the permit.

    Permittee means that person (applicant) to whom the permit is issued. The permittee bears the responsibilities of the applicant and in addition is responsible for the compliance of all work performed under the permit, and in accordance with this article.

    SRU means Salisbury Rowan Utilities, a department of the City of Salisbury.

    Record drawings means that complete set of drawings composed of one (1) reproducible, mylar copy of the approved plans showing actual installed conditions in accordance with City of Salisbury standard methods, including City of Salisbury Uniform Construction Methods, reflecting finished locations sufficiently dimensioned to fixed objects and elevations tied to NAVD 88, and sealed by the engineer of record.

    Sewer collection system has the meaning as stated in G.S. 143-213(15) in its most current amended form.

    Stop work order means an order issued by the city engineer to the permittee and/or contractor to cease and desist any further construction and/or modification work being performed under a permit issued pursuant to this article.

    Utility service area means the area described in G.S. 143-215.1(f) and G.S. 130A-317(d) as the "service area" for SRU.

    Warranty means the guarantee provided by the applicant to SRU prior to final acceptance of work, with such warranty being to protect SRU during the post acceptance warranty period. Such warranty shall carry language satisfactory to SRU as outlined in this article.

    Water distribution system has the meaning stated in North Carolina Administrative Code Title 15A Subchapter 18C Rule .1801, "the network of pipes valves, hydrants and related appurtenances but does not include pumps, storage tanks, treatment devices, wells or other facilities."
