§ 5-42. Keeping in annexed areas.

  • (a)

    The keeping of hogs or hog pens in areas annexed into the city shall be permitted for two (2) years after annexation, subject, however, to the following conditions:

    (1)

    Before any person shall keep or maintain any hogs or hog pens within the area defined in this section, he shall first apply for and secure a permit therefor. The application for such permit shall be in writing, shall be addressed to the county health officer, and shall state the name of the owner of the premises, the location thereof and the number of hogs to be kept or maintained on the premises in question. Upon the approval of any such application by the county health officer, a permit to keep or maintain hogs or hog pens shall be issued to the applicant by the health officer. There shall be no charge or fee for such permit and no application shall be denied unless the premises described in the application have been found by the health officer to be unsanitary or a menace to public health, or unless the keeping or maintaining of such hogs or hog pens would be in violation of any of the provisions of this section.

    (2)

    The floor of any hog pen maintained or erected in accordance with the provisions of this section shall be at least two (2) feet above the ground and there shall be an open space between the ground and such floor at least one (1) foot in height.

    (3)

    No such hog pen shall be erected or maintained within nine hundred (900) feet of any residence in the area nor within nine hundred (900) feet of any other hog pen.

    (b)

    Whenever a permit is issued under the provisions of this section, the county health officer or his designated agent shall examine the premises in question from time to time and if such premises shall for any reason become unsanitary or shall become a menace to public health the permit in question shall be revoked and after such revocation it shall be unlawful to continue to keep or maintain any hogs or hog pens upon such premises.
