§ 26-40. Exceptions from a special use permit for wireless telecommunications facilities.

  • (a)

    No person shall be permitted to site, place, build, construct or modify, or prepare any site for the placement or use of, wireless telecommunications facilities as of the effective date of this article without having first obtained a special use permit for wireless telecommunications facilities. Notwithstanding anything to the contrary in this section, no special use permit shall be required for those exceptions noted in the definition of wireless telecommunications facilities, such as those used exclusively for fire, police and other dispatch telecommunications, or exclusively for private radio and television reception and private citizen's bands, amateur radio and other similar telecommunications.

    (b)

    New construction, including routine maintenance or repair on existing wireless telecommunications facilities which results in a material modification of an existing facility, shall comply with the requirements of this article.

    (c)

    All wireless telecommunications facilities existing on or before September 19, 2000 shall be allowed to continue as they existed as of that date, provided however, that any material modification to existing wireless telecommunications facilities must comply with this article.

    (d)

    All telecommunications tower may be extended one (1) time by a maximum of fifty (50) feet upon satisfaction of all other requirements of this article, and after review and approval by the council if such review and approval is otherwise required by this article.
