§ 7-76. Demolition of structures within certain areas of the city restricted.

  • (a)

    No building shall be demolished within the national register historic districts that are within the downtown municipal service district and are not in a designated local historic district (as shown on the attached map*), without a permit issued by the city council.

    (b)

    This section applies to all properties located within the national register historic districts that are within the downtown municipal service district and are not in a designated local historic district, as shown on the attached map*.

    (c)

    This section shall be effective upon enactment and shall stay in effect until June 30, 2001, or the rescission by city council, whichever first occurs.

    (d)

    The city council will use, but is not limited to, the following criteria to determine the appropriateness of the demolition request:

    (1)

    Location of the structure,

    (2)

    Building classification (to be determined by the state historic preservation office), and

    (3)

    Proposed future design of the property (i.e. mass, scale, spacing, orientation, rhythm, etc.), and

    (4)

    The impact on any pre-existing downtown development plan.

    (e)

    This section shall not apply to the demolition of any structures for which permits have already been issued.
