§ 7-77. Demolition of structures within the downtown local historic district.

  • (a)

    No structure within the downtown local historic district ('H' historic overlay as adopted by the city council on October 2, 2001, and as amended hereafter) may be demolished without a permit issued by the city council pursuant to N.C.G.S. Session Law 2007-102.

    (b)

    In determining whether or not to issue the permit, the city council shall take into consideration the factors set forth in section 7-65, as well as the following conditions:

    (1)

    Location of the structure within the historic district;

    (2)

    State of repair of the structure;

    (3)

    Architectural and historical significance of the structure;

    (4)

    Overall impact of the demolition of the structure on the historic district;

    (5)

    Issuance of a certificate of appropriateness for the demolition by the Salisbury Historic Preservation Commission pursuant to the requirements set out in N.C.G.S. 160A-400.14.

    (c)

    All applicable fees, bonds, notice and hearing requirements shall be according to the provisions set forth in article IV.
