§ 25-109. Construction in rural area.

  • (a)

    All extensions of water or sewer mains constructed in the rural area outside of the urban growth area boundary of the city and financed by a developer shall be constructed under written agreements between the city and the person requesting such extension. Such agreements shall be approved by the city council.

    (b)

    The city may not participate in the costs of extending water and sewer lines to serve developments located in the rural area. The city council may, at its discretion, based upon availability of funds, make exceptions to this rule for major economic development projects and to serve other local governments. All water and sewer mains so extended shall be the property of the city.
